{"id":188,"date":"2020-12-08T16:49:20","date_gmt":"2020-12-08T16:49:20","guid":{"rendered":"https:\/\/ese-tst.syr.edu\/studentconduct\/?page_id=188"},"modified":"2026-08-09T00:42:05","modified_gmt":"2026-08-09T00:42:05","slug":"formal-hearing-process","status":"publish","type":"page","link":"https:\/\/experience.syracuse.edu\/community-standards\/conduct-process\/formal-hearing-process\/","title":{"rendered":"Formal Hearing Process"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Complete hearing procedures can be found in the&nbsp;<a href=\"https:\/\/experience.syracuse.edu\/community-standards\/conduct-handbook\/\">Student Conduct&nbsp;System Handbook<\/a>.<\/p>\n\n\n\n\n\n\n\n<p class=\"wp-block-paragraph\">If a case isn&#8217;t resolved through Resolution by Agreement, it&#8217;s referred for a formal hearing with the <a href=\"https:\/\/experience.syracuse.edu\/community-standards\/conduct-process\/conduct-handbook\/definitions\/\">University Conduct Board or Administrative Hearing Officer<\/a> as outlined in <strong>Part 8 of the Student Conduct\u00a0System Handbook<\/strong>. <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The hearing gives students the chance to present relevant information and evidence about the alleged violation. <\/li>\n\n\n\n<li>Hearings are held via Zoom unless noted otherwise, and they are not legal proceedings, so rules of evidence and the criminal standard of proof do not apply. <\/li>\n\n\n\n<li>Hearings are confidential and closed to anyone not directly involved in the case, and all participants are expected to keep proceedings confidential.<\/li>\n\n\n\n<li>Students are encouraged to have a <a href=\"https:\/\/experience.syracuse.edu\/community-standards\/resources\/procedural-advisement\/\"><strong>procedural advisor<\/strong><\/a> to support them through the hearing, as described in Part 5 of the Handbook. An advisor has no formal standing in the hearing but can offer advice as long as it doesn&#8217;t disrupt the process. <\/li>\n\n\n\n<li>If a student needs help finding a procedural advisor, they can contact Community Standards at <a href=\"mailto:studentconduct@syr.edu\">studentconduct@syr.edu<\/a>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">The sequence of proceedings in the formal hearing is typically as follows:<\/h2>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>introductions and reading of the complaint;<\/li>\n\n\n\n<li>reading of the alleged charges against the Respondent, and the Respondent\u2019s response to these charges;<\/li>\n\n\n\n<li>opening statements;<\/li>\n\n\n\n<li>presentation of information\/witnesses by the Case Presenter, questioning of participating parties\/witnesses through the Hearing Chair\/Administrative Hearing Officer;<\/li>\n\n\n\n<li>presentation of information\/witnesses by the Respondent, questioning of the Respondent through the Hearing Chair\/Administrative Hearing Officer;<\/li>\n\n\n\n<li>closing statement by the Complainant and\/or Case Presenter;<\/li>\n\n\n\n<li>closing statement by the Respondent.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Hearing board decisions are made in private and by a majority vote of the board members.&nbsp; All hearing board decisions are subject to confirmation by the Director of Community Standards or designee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All parties will be informed of the confirmed hearing board decision in writing within ten (10) University business days after the conclusion of the hearing.&nbsp; A hearing is considered concluded when all hearing board deliberations are complete.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Students may appeal any formal hearing outcome. <a href=\"https:\/\/experience.syracuse.edu\/community-standards\/conduct-process\/appeal-process\/\" data-type=\"link\" data-id=\"https:\/\/experience.syracuse.edu\/community-standards\/conduct-process\/appeal-process\/\">Appeals<\/a> information can be found in Part 10 of the Student Conduct System Handbook. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Complete hearing procedures can be found in the&nbsp;Student Conduct&nbsp;System Handbook.
